Bennett, charged with voluntary manslaughter in connection with the death of 11 yr old Clifford Allen Reidmiller, was continued in Criminal Court yesterday until February 1 by agreement of counsel for the Commonwealth and defendant. No reason was assisgned by counsel for the continuance but it was learned from another source that the efforts are being made to compromise the case and stop prosecution of Bennett on the criminal charge. Young Reidmiller was run down by an automobile September 25, 1915, near the intersection of 21st and Jefferson Streets and died October 12. He was carried by Bennett to his home nearby and after the death of the lad the case was called to the attention of the Grand Jury and the indictment followed.
NEWSPAPER ARTICLE: Courier-Journal (1869-1922)April 18, 1916 pg 10: CHARGE AGAINST AUTOIST DISMISSED AT REQUEST OF VICTIM'S FATHER, George Reidmiller Says He Doesn't Think C.B. Bennett Guilty Of Negligence, Acting on a written request of George Reidmiller, whose 9 year old son, Clifford Allan Reidmiller, was run down and killed by an automobile several months ago, the Commonwealth yesterday dismissed an indictment against C.P. Bennett, charge with voluntary manslaughter in connection with the boy's death. In a written statement submitted to the Commonwealth's Attorney and filed in court the father said he felt sure Bennett had not been guilty of any negligence in operating the automobile and that although the accident had proven a sad one to him and his family he did not care to inconvenience Bennett further by prosecuting him. In filing the statement and asking for a dismissal of the indictment Assistant Commonwealth Attorney Mix said, the Reidmiller boy and other children were playing in the strett in a toy automobile and that in attempting to avoid striking one or more of the children the machine driven by Bennett collided with the toy machine, causing the death of the Reidmiller boy. He said he had investigated every angle of the case by the questioning of all the witnesses and felt sure the Commonwealth would be unable to show negligence in the event the prosecution was pressed and for that reason he would join with the father and ask for a dismissal of the indictment.
